Terms of Service

These Terms of Service ("Terms") govern your use of the FormBlade service operated by Zoniax, a company registered in the European Union ("Company", "we", "us"). By using FormBlade, you agree to these Terms.

1. Service Description

FormBlade is a form backend service that allows you to collect form submissions from websites, receive email notifications, and manage submission data through a dashboard. We provide hosted form pages, email delivery, data storage, and related tools.

2. Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the service
• One person or legal entity per account unless on a Team/Business plan
• You are responsible for all activity that occurs under your account

3. Plans and Billing

Personal plan: Available at no cost with usage limits as described on our pricing page. We may modify Personal plan limits with 30 days notice.

Paid plans: Billed monthly or annually as selected. Payments are processed by Paddle. All prices are in USD and exclude applicable taxes (VAT is added for EU customers).

Refunds: Annual plans are refundable within 14 days of purchase if no significant usage has occurred. Monthly plans are non-refundable but can be cancelled at any time — you retain access until the end of the billing period.

Plan changes: You may upgrade or downgrade at any time. Upgrades take effect immediately. Downgrades take effect at the end of the current billing period.

4. Acceptable Use

You agree not to use FormBlade to:

• Collect data without proper legal basis or user consent
• Send spam, phishing, or unsolicited bulk email
• Collect sensitive data (health, financial, government IDs) without appropriate safeguards
• Engage in any illegal activity or violate applicable laws
• Attempt to circumvent plan limits, rate limits, or security measures
• Use automated tools to create accounts or submit forms in bulk for abuse
• Host malware, deceptive content, or fraudulent forms

We reserve the right to suspend or terminate accounts that violate these terms.

4a. Webhooks, Notifications & Integrations

Webhooks: When you configure a webhook, FormBlade sends submission data to the URL you provide. You are solely responsible for the security and privacy of data received at your endpoints. We recommend using HTTPS endpoints and verifying the HMAC signature we include with each delivery.

Telegram: When you enable Telegram notifications, you provide your own bot token and chat ID. FormBlade sends submission data to Telegram on your behalf. You are responsible for securing your bot token and the privacy of data delivered to your Telegram chat.

Embedded widgets: You may embed FormBlade forms on third-party websites using our widget script, iframes, or HTML snippets. You are responsible for complying with applicable privacy laws on the websites where you embed forms, including displaying appropriate privacy notices to your visitors.

5. Data Processing (GDPR)

Under the EU General Data Protection Regulation (GDPR):

• You are the Data Controller for submission data collected through your forms
• We act as a Data Processor on your behalf
• We process data only as necessary to provide the service
• We do not use submission data for our own purposes
• We maintain appropriate technical and organizational security measures
• We will notify you without undue delay of any personal data breach

6. Your Responsibilities

• Ensure your forms comply with applicable privacy laws (GDPR, CCPA, etc.)
• Provide a privacy policy to your form users explaining data collection
• Configure appropriate privacy settings (consent, retention, IP anonymization)
• Respond to data subject access and deletion requests from your form users
• Keep your account credentials secure

7. Third-Party Account Connections

FormBlade allows you to connect third-party accounts (Google, Microsoft) for authentication and email sending:

• You may sign in using your Google or Microsoft account
• You may connect your Gmail or Outlook account to send form notification emails on your behalf
• Connections are optional and can be removed at any time from the Connections page
• We store OAuth tokens securely and use them solely for the stated purpose
• Use of Google APIs complies with the Google API Services User Data Policy
• You can revoke access at any time from your Google or Microsoft account settings

8. Intellectual Property

FormBlade, its logo, and the service are the intellectual property of Zoniax. You retain ownership of all data you submit to the service, including form configurations and submission data.

Forms created with FormBlade may display "Powered by FormBlade" branding on the Personal plan. This branding is removable on paid plans.

9. Service Availability

We aim for high availability but do not guarantee 100% uptime. We are not liable for service interruptions due to maintenance, infrastructure issues, or factors beyond our control. Business customers may negotiate SLA terms separately.

10. Limitation of Liability

To the maximum extent permitted by applicable EU law:

• The service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss caused by your misconfiguration of retention or deletion settings

11. Termination

By you: You may delete your account at any time. This permanently deletes all forms, submissions, and files. This action cannot be undone.

By us: We may suspend or terminate your account for violation of these Terms with notice. In case of severe abuse, we may act immediately.

Upon termination, you may export your data beforehand using the dashboard export feature.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days in advance. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the European Union and the member state where Zoniax is registered. Any disputes shall be resolved in the courts of that jurisdiction, without prejudice to your consumer rights under EU law.
